Several American Visual artists have joined together in a class action lawsuit against some popular AI image and video generation companies are celebrating today after a judge ruled their copyright infringement case against the AI companies can move forward toward discovery.  The case was filed back in January of 2023. The Artists involved include Sarah Andersen, Kelly McKernan, Karla Ortiz, Hawke Southworth, Grzegorz Rutkowski, Gregory Manchess, Gerald Brom, Jingna Zhang, Julia Kaye, and Adam Ellis have, on behalf of all artists, accused Midjourney, Runway, Stability AI, and DeviantArt of copying their work by offering AI image generator products based on the open source Stable Diffusion AI model, which Runway and Stability AI collaborated on and which the artists alleged was trained on their copyrighted works in violation of the law. While Judge William H. Orrick of the Northern District Court of California, which oversees San Francisco and the heart of the generative AI boom, didn’t yet rule on the final outcome of the case, he wrote in his decision that the “the allegations of induced infringement are sufficient,” for the case to move forward toward a discovery phase — which could allow the lawyers for the artists to peer inside and examine documents from within the AI image generator companies, revealing to the world more details about their training datasets, mechanisms, and inner workings. “This is a case where plaintiffs allege that Stable Diffusion is built to a significant extent on copyrighted works and that the way the product operates necessarily invokes copies or protected elements of those works,” Orrick’s decision states. “Whether true and whether the result of a glitch (as Stability contends) or by design (plaintiffs’ contention) will be tested later. The allegations of induced infringement are sufficient.” Artists react with glee. “The judge is allowing our copyright claims through & now we get to find out all the things these companies don’t want us to know in Discovery,” wrote one of the artists filing the suit Kelly McKernan, on her account on the social network X. “This is a HUGE win for us. Despite tech conglomerate Cisco posting $10.3 billion in profits last year, it’s still laying off 5,500 workers as part of an effort to invest more in AI, SFGATE reports, It joins a litany of other companies like Microsoft and Intuit, the maker of TurboTax, that have used AI as justification for the mass culling of its workforce. The layoffs at Cisco came to light in a notice posted to the Securities and Exchange commission, affecting seven percent of its staff.  In a short statement, CEO Chuck Robbins used the term “AI” five times, highlighting the company’s efforts to keep up in the ongoing AI race.  Earlier this year, Cisco also laid off 4,000 or five percent of its staff, saying that the company wanted to “realign the organization and enable further investment in key priority areas.” In short, companies are no longer hiding their optimism over replacing human labor with AI, an unfortunate reality for those looking to maintain a stable job. But whether this “realignment” will pay off in the long run remains to be seen. Red Herring The layoff news helped boost Cisco’s stock price, going from $45.04 in the morning to spiking over $48 per share in after-hours trading.  We’ve already seen similar spikes in the stock prices of other tech companies announcing layoffs. Cisc’s layoffs are also part of another pattern: tech companies saying they are shifting resources to boost their AI efforts and therefore they need to lay off people as part of a restructuring campaign. While many companies have used AI as a public-facing excuse for their restructuring efforts, experts remain skeptical and think the tech is instead used as a cover. “Fighting against robots is a nice cover story,” University of Oxford economist and data scientist Fabian Stephany told Business Insider earlier this year. “But if you have a closer look, it’s often old school, simple economic dynamics like outsourcing or lead management cutting costs to increase salaries in other places.” Unwavering Dedication Off the back of a strong third quarter, Microsoft is reportedly laying off somewhere between  1,000 and 1,500 across its Azure cloud and mixed reality departments. And in a leaked memo as tone-deaf as it is bland, an executive at the company proclaimed that their peons’ sacrifices are not in vain, for they are being done on the altar of the almighty “AI wave.” “Our clear focus as a company is to define the AI wave and empower all our customers to succeed in the adoption of this transformative technology,” wrote Jason Zander, executive vice president of Strategic Missions and Technologies at Microsoft, in an email to employees, as quoted by Business Insider, he writes. “Along the way, we make decisions that align with our long-term vision and strategy while ensuring the sustainability and growth of Microsoft.” For a Few Billion More Layoffs at big tech companies are obligatory these days, even though the corporations are more powerful and wealthy than ever. This is frequently chalked up to systemic overhiring — which may well be true to a certain extent — but it’s clear that those jobs are also being swept out to make room for investments in AI. Microsoft last year, for example, laid off 10,000 employees right as it announced it was shoveling another $10 billion in OpenAI. Among those fired was every single person who worked in the company’s AI “Ethics and Society division — a dismal sign of things to come. Since then, it’s emerged that the company is reportedly willing to spend an eye-watering $100 billion to build a supercomputer to train an advanced new AI. And despite its existing hefty investments in OpenAI, Microsoft also reportedly wants to develop its own large language model. Brain Drain Those investments come at a cost: monetary, of course, but also human. The layoffs at Microsoft have been less sweeping this year, but behind the scenes, there’s a lot of reorganizing going on, including the formation of a whole new division simply called “Microsoft’s AI” as the company shifts more workers to projects like Copilot, its ChatGPT-like assistant.” It’s never easy to make these tough decisions, particularly when they affect our colleagues and friends,” Zander wrote, affecting their best impression of a human that’s torn-up about their actions. “We’re dedicated to supporting everyone impacted by these changes with respect, dignity, and transparency to fully support them through this transition.”  The use cases that would be “productive,” and have thus been the most hyped, have seen less success in AI adoption. One of the constant concerns that we humans must deal with is how AI and Robots, are going to displace people’s jobs or their employment.  In this supposed Utopian world, as the proponents like to paint, AI can just “help” us to do more and to be more creative. Aside from some very much simpler things, we’re coming to find that that claim of productivity and creativity is bovine feces. Sorry but it is. Regarding “more”, that assumes a matter of degree.  Doing “more” depends on what the person is doing.  Picking a crop or doing more accounting assignments, maybe.  But in the venue of “creativity”, for humans, it comes to human involvement being eliminated altogether. It is a serious risk for us humans.  In passing, I will advise you that I will soon be writing about artwork. It’s not a pretty picture for sure.  The subject of artwork, using AI becomes ‘black and white’, in or out matter but we shall delve into that shortly. The advocates for AI, and robots, claim that 80% plus, of all human jobs, human employment can be done by AI or a robot. Nice to know. I’m not sure that the prospects of using AI and Robots are all that appealing to me, but that is their claim. So, the logical extension of that scenario, in then displacing human work and human employment going forward.  The big problem when you do that, it creates massive amounts of unemployment, which can lead to poverty, amongst other things. So, the logical conclusion to that massive amount of and use of for AI and robots is majorly problematic. AH, but wait, the AI proponents have already figured out the solution don’t you know?  It is called UBI or Universal Basic Income.  It’s where we humans jump from the frying pan into the fire. Under that UBI fantasy, the majority (?) of people get an amount of money, likely monthly, to sustain themselves, while not having the drudgery of having to work for that money.  Aside from coming to sound like socialism, which always fails as a social system, it then led to communism, which never works. So, in effect. UBI starts out as Socialism, devolving into communism. As a practical matter, when you press the UBI proponents “where” the money is going to come from, some of the more ridiculous answer I’ve seen, is “…oh, well the government will just create the money”.  Oh, you mean like now, creating trillions of new dollars as the currency descends into a black hole of inflation as it, over time, becomes worthless? But there is more: So, the conclusion, the ultimate end of all of this is a dead end. People need to start thinking about what they want and what they are willing to endure, regardless of whether Time Magazine or any other publication tells them. Humanity is in a danger zone with AI. We need to start realizing that the peaches and cream, utopian future that we are being given, has a few issues we will come to face. As a person, you need to awake to the facts. You need to educate yourself that all is not as it is being painted. The challenges are real. The dangers are real. Slick AI advertising and magazine articles will not change the issues.
